TERMS AND CONDITIONS OF THE “LADYBUQ” ONLINE STORE
ART. STUDIO DARIUSZ BEŁCH

§ 1
GENERAL PROVISIONS

The online store available at www.ladybuqart.pl is operated by Dariusz Bełch, conducting business under the name: “LadyBuq” Art. Studio Dariusz Bełch, Kraczkowa 1079a, 37-124 Kraczkowa, Poland, Tax Identification Number (NIP): 813-30-94-872, REGON: 18-00-10-042.

These Terms and Conditions specify, among others, the rules and conditions for using the Online Store, including in particular:

rules for registration and use of the Online Store;

rules and conditions for placing Orders for Goods in the Online Store;

rules and conditions for concluding Sales Agreements via the services offered within the Online Store;

rules for the execution of such agreements, for items in LadyBuq’s assortment;

complaint procedures.

All products in the Online Store’s assortment are brand new. The Seller informs that products offered in the Online Store are handmade. Each item is made only after an order is placed by the Customer. Therefore, LadyBuq uses only natural materials and raw materials for production, which may have slight differences in color, thickness, discoloration, and other features associated with the characteristics of natural leather.

LadyBuq reserves that the color of internal pockets may be random.

To use the Online Store, including browsing the assortment and placing orders, the following minimum technical requirements must be met:

having a computer/other multimedia device with Internet access;

having an internet browser:

Internet Explorer 8.0 or newer with ActiveX, JavaScript, and Cookies enabled, or

Mozilla Firefox 22.0 or newer with Java applets, JavaScript, and cookies enabled, or

Google Chrome 28.0 or newer with Java applets, JavaScript, and cookies enabled, or

Opera 12.0 or newer with Java applets, JavaScript, and cookies enabled, or

Apple Safari 5.0 or newer with Java applets, JavaScript, and cookies enabled;

having an active email account;

recommended minimum screen resolution: 1024 x 768 pixels.

§ 2
DEFINITIONS
ORDER PROCESSING TIME – means the number of business days in which LadyBuq will fulfill/produce the order placed by the Customer via the Online Store.
Order processing time does not include:

the time of handing over the ordered goods to the courier/Polish Post for delivery to the Customer, and

the time of delivery of the ordered goods by the courier to the address indicated by the Customer in the order.
Order processing time for items ordered from LadyBuq is from three to fifteen business days. LadyBuq will make every effort to ensure the shortest possible order processing time.
BUSINESS DAYS – days from Monday to Friday, excluding public holidays in the Republic of Poland.
LIMITED EDITION – products manufactured by LadyBuq in limited quantities; orders will be processed in the order received until stock is depleted. In such cases, LadyBuq reserves the right to withdraw from the contract.
CUSTOM ORDER – a service provided by LadyBuq, consisting of the Customer placing an order via the Online Store for a product made according to the Customer’s design/idea. The custom order will be executed by LadyBuq only after all essential elements (design: shape, color, price) are agreed upon and finally approved by both parties via email.
Changes (e.g., color, shape, handle/strap length, additional pocket) to products offered on the LadyBuq Online Store website are also considered custom orders. Custom order designs are also subject to individual pricing by LadyBuq.
Custom orders cannot be canceled or returned. Custom orders are processed after payment is received.

LadyBuq – The Seller, i.e., “LadyBuq” Art. Studio Dariusz Bełch, Kraczkowa 1079a, 37-124 Kraczkowa, Poland, NIP: 813-30-94-872, REGON: 18-00-10-042.
CUSTOMER – a natural person placing an Order in the Online Store, who is at least 18 years old and has full legal capacity.
CONSUMER – a Customer who is a natural person making a legal transaction with LadyBuq not directly related to their business or professional activity, in particular placing an order in the Online Store – as per Article 221 of the Civil Code.
ORDER CONFIRMATION, ORDER WITH PAYMENT OBLIGATION – means the Customer places an order with a payment obligation.
SERVICE – means the websites through which the Seller operates the Online Store.
STORE – the Online Store operating at www.ladybuqart.pl, operated by LadyBuq Art. Studio Dariusz Bełch, Kraczkowa 1079a, 37-124 Kraczkowa, Poland.
PRODUCT – an item available in the Online Store for which an Order can be placed.
DISTANCE CONTRACT – a contract concluded between the Parties without their simultaneous physical presence, using remote communication channels available in the Store.
ORDER – a declaration of intent by the Buyer, on the basis of which they purchase products offered by LadyBuq. The Order contains all detailed information necessary for its fulfillment.

§ 3
RULES FOR USING THE SERVICE – CREATING A CUSTOMER ACCOUNT, LOGGING IN
To use the Online Store, the Customer must register, accept these Terms and Conditions, and consent to the processing of their personal data for the purpose of order fulfillment by LadyBuq.
Registration on the Store’s website is voluntary and free of charge.
By completing the registration form, the Customer declares that:

the data provided is complete and accurate,

they have read and agree to comply with the Terms and Conditions.
The Customer may register a Customer Account in the Online Store by clicking the “Create Account” tab on the main page at www.ladybuqart.pl or during the ordering process.
During registration, the Customer must provide:

an email address (which will serve as the login),

a password (for account login),

first and last name.
Upon correct entry of the above registration data and selecting “create account,” the system will automatically send an email to the address provided during registration with instructions on how to activate the account.
After registering the Customer Account, the Customer can log in to the Online Store using the registered email address and password.
The Customer may browse the Online Store’s assortment and place orders without registering an account. However, registered Customers have the ability to track order history and order status.
Data marked as mandatory is necessary to create a Customer Account and process orders. Providing mandatory data is voluntary but necessary to create an account. Optional data is not required.
The electronic service agreement enabling the Customer to create and use a Customer Account is concluded when the Customer receives an email confirming account registration.

§ 4
PLACING AND ACCEPTING ORDERS
The subject of orders in the LadyBuq Online Store are products available at www.ladybuqart.pl.
A necessary element in the ordering procedure is the Customer’s review and acceptance of these Terms and Conditions, confirmed by checking the appropriate box before completing the order. Lack of acceptance prevents purchase.
The Customer must also provide the personal data marked as mandatory in the order form and consent to the processing of this data for order fulfillment.
To place an Order, the Customer should visit the Store’s website and follow the on-screen instructions.
Orders are placed using the Order Form, available after logging in or without registration. Products are added to the cart by clicking “Add to Cart.”
To place an order via www.ladybuqart.pl:

select the product and add it to the cart,

choose delivery method,

choose payment method,

complete the order form,

confirm and submit the order by clicking “Confirm Purchase, Order with Payment Obligation.”
The order form requires:

first and last name of the Customer/Consumer,

address,

phone number,

email address,

recipient’s data and delivery address, if different.
After completing all required data and selecting delivery and payment methods, an order summary will appear, including:

ordered products,

unit and total prices,

delivery cost.
During the ordering process, until clicking “Confirm Purchase, Order with Payment Obligation,” the Customer can modify the order, including product selection, delivery area, payment method, and data. To edit, click “Edit/Back.”
Submitting the Order is done by clicking “Order with Payment Obligation.”
Submitting the Order constitutes an offer to conclude a sales contract with LadyBuq.
After receiving the Order, LadyBuq will send a confirmation email to the Customer. The sales contract is concluded upon receipt of this email. The confirmation will include the Order number.
The sales contract is concluded in Polish and is in accordance with these Terms and applicable law.
The service of enabling Customers to place orders via the Online Store is free and one-time. The service ends upon order fulfillment by LadyBuq.
If, after placing an order for several products, part of the order cannot be fulfilled within the expected time, LadyBuq will inform the Customer via email. The Customer may cancel the unfulfillable part or the entire order by informing LadyBuq via email or in writing.
If the ordered product is unavailable or cannot be fulfilled in time, LadyBuq reserves the right to cancel the Order.
If the Customer has already paid for the product in advance, LadyBuq will promptly refund the price or the appropriate part, using the same payment method unless the Customer agrees otherwise.
The Seller reserves the right to refuse to confirm or fulfill an Order if:

the Order Form is incomplete or incorrectly filled out;

the order violates the Terms and Conditions.

§ 5
PRICES OF GOODS IN THE ONLINE STORE
All prices are quoted in Polish zloty (PLN) and include VAT.
Prices do not include shipping costs. Shipping costs are added as a separate item in the Order summary. Shipping cost information is provided before the sales contract is concluded.
Prices provided by LadyBuq are binding at the time of placing the Order via www.ladybuqart.pl.
Payment for the ordered product may be made by:

cash on delivery – payment to the courier upon receipt;

via PayPal;

by credit card (Visa, MasterCard);

personal pickup at LadyBuq’s location.
Failure to pay within 7 business days from the order date is considered order cancellation. After this period, LadyBuq will cancel the order.

§ 6
PAYMENT METHODS
For orders delivered within Poland, the Customer may choose:

cash on delivery – payment upon receipt from the courier or at LadyBuq’s location (personal pickup);

prepayment – electronic payment by credit card (Visa, MasterCard) / online bank transfer via PayPal / traditional bank transfer (PLN / € / $).
For orders delivered within the European Union:

prepayment – electronic payment by credit card (Visa, MasterCard) / online bank transfer via PayPal / traditional bank transfer (PLN / € / $).
For orders delivered outside the European Union (e.g., Canada, USA, others):

prepayment – electronic payment by credit card (Visa, MasterCard) / online bank transfer via PayPal / traditional bank transfer (PLN / € / $).
Customers who choose prepayment must pay within 7 days of receiving the order confirmation email from LadyBuq.
Customers who choose cash on delivery must pay upon receipt.
Credit card or online bank transfer payments are processed via PayPal.

§ 7
ORDER FULFILLMENT, TIME, METHOD, AND COST OF DELIVERY
Products ordered via the Online Store are delivered within Poland, the European Union, and outside the EU.
Delivery times and costs vary by destination country:
Within Poland:

Orders are delivered via FEDEX or Polish Post;

Shipments are sent Monday to Friday, excluding public holidays;

Shipping costs:

Prepayment – 25.00 PLN

Cash on delivery – 25.00 PLN

Personal pickup – 0 PLN

Shipping costs may depend on the number of items ordered.

Delivery time must be added to the order processing time.
Within the European Union:

Orders are delivered via FEDEX. If no phone number is provided, LadyBuq will use Polish Post or cancel the order.

Shipments are sent Monday to Friday, excluding public holidays;

Shipping cost:

Prepayment – 80.00 PLN

Shipping costs may depend on the number of items ordered.

Delivery time must be added to the order processing time.
Outside the European Union:

Orders are delivered via FEDEX or Polish Post. If no phone number is provided, LadyBuq will use Polish Post or cancel the order.

Shipments are sent Monday to Friday, excluding public holidays;

Shipping cost:

Prepayment – 57.85 USD (applies only to destinations with predetermined shipping costs; if higher, LadyBuq will inform the Customer).

Shipping costs may depend on the number of items ordered.

Delivery time must be added to the order processing time.

The Customer may be charged customs duties, about which LadyBuq will inform by email.
For deliveries to Poland, the EU, and outside the EU, the Customer bears the shipping costs.
Order processing time is 3 to 15 business days from:

for cash on delivery – from the date LadyBuq sends an order confirmation email;

for credit card/online transfer/traditional transfer – from the date LadyBuq receives payment confirmation.
Products are delivered with a receipt (VAT invoice) covering the order.
In Poland, unless the Customer requests a VAT invoice, a receipt will be included.
LadyBuq informs that products are made only after the Customer places an order and pays in full, except for cash on delivery orders.

§ 8
CONSUMER RIGHT OF WITHDRAWAL
Sales contracts concluded via the Online Store are distance contracts under the Act of May 30, 2014, on consumer rights. Consumers may withdraw from the contract within 14 days of delivery without giving a reason, except for products made to the Consumer’s specifications or clearly personalized (custom orders), as per Article 38(3) of the Act.
Instructions on withdrawal, including procedures and costs, are provided in Appendix 1.
The withdrawal statement may be combined with the physical return of the product. The Consumer may use the withdrawal form (Appendix 2). The Consumer bears the return shipping cost.
Upon withdrawal, LadyBuq will refund the purchase price and delivery costs, except for any additional costs resulting from a delivery method other than the least expensive standard method offered by LadyBuq.
The completed form or withdrawal statement should be sent to: “LadyBuq” Art. Studio Dariusz Bełch, Kraczkowa 1079a, 37-124 Kraczkowa, Poland, or shop@ladybuqart.pl.
Upon withdrawal, LadyBuq will refund all payments received, including delivery costs (except additional costs), within 14 days of receiving the withdrawal statement.
For orders from outside the EU, LadyBuq will refund only the purchase price.
Refunds will be made using the same payment method unless the Consumer agrees otherwise.
The Consumer must return the product within 14 days of notifying LadyBuq of withdrawal. Timely shipment suffices.
Return address: “LadyBuq” Art. Studio Dariusz Bełch, Kraczkowa 1079a, 37-124 Kraczkowa, with “Return” noted.
The product should be returned in a rigid box, with tags and proof of purchase, and must be properly packed to prevent damage.
LadyBuq may withhold the refund until receiving the product or proof of return.
The Consumer is liable for any diminished value resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the item.

§ 9
GENERAL INFORMATION ON PRODUCT COMPLAINTS
If the Customer believes the purchased product is defective, they may request repair or replacement.
To do so, the Customer should:

return the product (if possible, in original packaging with proof of purchase) to: “LadyBuq” Art. Studio Dariusz Bełch, Kraczkowa 1079a, 37-124 Kraczkowa, Poland, with “Complaint” noted;

submit a written complaint statement (form in Appendix 3 may be used);

indicate whether they seek repair or replacement, describe the defect and date of occurrence;

provide contact details for complaint handling.
LadyBuq will review complaints within 14 days.
If the complaint is accepted, LadyBuq will repair or replace the product as requested, unless impossible or excessively costly compared to the alternative.
LadyBuq will cover justified complaint costs, including documented shipping costs.
Color changes or fading are not considered grounds for complaint, as products are made from natural leather, which may have differences in texture, shade, thickness, marks, scars, or wrinkles. These are natural features, not defects.
Any size discrepancies should be consulted with LadyBuq, as differences may arise from measuring irregularly shaped bags at different points.
Differences resulting from individual computer settings (color, proportions, etc.) are not grounds for complaint.
LadyBuq is obliged to deliver products free from physical and legal defects. LadyBuq is liable for defects as specified in the Polish Civil Code.

§ 10
OUT-OF-COURT DISPUTE RESOLUTION
You have the right to use out-of-court complaint and redress procedures. Details are available at consumer ombudsman offices, Provincial Inspectorates of Trade Inspection, and consumer protection organizations.

§ 11
PROCESSING OF CUSTOMER PERSONAL DATA
Privacy Policy
This Privacy Policy sets out the rules for processing personal data and cookies collected by the online store at http://www.ladybuqart.pl/ (“Online Store”), operated by LadyBuq Art Studio Dariusz Bełch, Kraczkowa 1079a, 37-124 Kraczkowa, Poland.
Protecting your information is of utmost importance to us; we strive to ensure you feel safe entrusting your personal data to us when using our website. This policy explains how we process your data, your rights, and our obligations as data controller.

LadyBuq Art Studio processes Users’ personal data to properly perform contracts concluded via www.ladybuqart.pl, including:

registration in the Service

contract conclusion

settlements

delivery of ordered products

exercising consumer rights (e.g., withdrawal).
If you consent to receive news and promotions, LadyBuq Art Studio will process your data to send you marketing information.
The Customer acknowledges that personal data on the outside of shipments, such as on shipping labels, is visible to third parties, but this does not constitute a data breach.

LadyBuq Art Studio processes the following personal data, required for:

PESEL (for invoices)

For contract withdrawal or complaint refunds, bank account number may be required.

Legal Basis
Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR).
Your data is processed with your consent, given during registration and when confirming a transaction.
Consent is voluntary, but lack of consent prevents registration and purchases.
You have the right to:

withdraw consent at any time, for any or all purposes; withdrawal will result in account deletion and cessation of data processing;

request data deletion at any time;

object to processing, causing account deletion;

request restriction of processing for a specified time or scope;

request correction of data at any time (can also be done via “MY ACCOUNT” after logging in).

Data Retention
Your personal data is stored until your account is deleted.
Archived transaction data may be retained for legal reasons.

§ 12
FINAL PROVISIONS
If any provision of these Terms is found invalid or ineffective, the remaining provisions remain in force. The invalid provision will be replaced by one most closely reflecting its purpose.
Contracts are concluded in Polish.
These Terms are available electronically at www.ladybuqart.pl and at LadyBuq’s office. By placing an order, the Customer is deemed to have read and accepted these Terms.
LadyBuq informs that colors on digital media may slightly differ from actual colors.
LadyBuq is not responsible for incorrect delivery addresses provided by the Customer; related costs are borne by the Customer.
LadyBuq responds to all customer emails as soon as possible, but no later than 7 days after receipt.
If the Customer fails to collect an ordered shipment, LadyBuq reserves the right to seek reimbursement of delivery costs and compensation for any loss incurred.
The Customer must check the shipment in the courier’s presence.
By using the Online Store, the Customer/Consumer is obliged to:

not provide unlawful content or use the Store in violation of the law;

not infringe the rights of others;

use information from the Store (including marketing materials) for personal use only;

comply with Polish law and these Terms;

not take unlawful actions damaging LadyBuq’s reputation.
LadyBuq reserves the right to amend these Terms for legal or organizational reasons. Changes will be announced at www.ladybuqart.pl.
Orders placed before changes will be fulfilled according to the Terms in effect at the time of order.
Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code and, for Consumers, the Act on Consumer Rights.
Appendices to these Terms: Customer notice – Appendix 1, withdrawal form – Appendix 2, complaint form – Appendix 3.
These Terms are effective as of June 7, 2015, and apply to contracts concluded from that date.
